Bella
Carta owns the photos we take, and all subsequent designs,
alterations, and resulting images regardless of the subject(s) in
the photos. Outlined in this document are the fair-use scenarios
allowed by Bella Carta. Bella Carta reserves the right to use any
photo we take or custom design we create in any way it deems
appropriate, including but not limited to advertisements in
magazines, on billboards, telephone directories, etc.; example
booklets and brochures; business applications such as business
cards, promotional materials, and letterheads; any electronic
conveyance including websites and social-networking announcements;
and for any physical example or display purposes including framed
works, canvas prints, and photo albums.
Proofs
Your proofs, delivered to you via email or physical ProofPages, are
property of Bella Carta. You are under no obligation to return the
proofs, and you may keep the proof email for your records. You may
print hard copies of your proof email in its entirety for personal
archival purposes. You may forward your proof emails to third
parties such as family and friends as long as it's as a whole, not
just the pictures.
You may
NOT:
• Have any prints made from digital proofs or traditional proof
pages by anyone other than Bella Carta.
• Use the digital proofs for any online representation, including
but not limited to Myspace and Facebook profiles, without permission
from Bella Carta.
• Make any hard copy of your ProofPages.
• Remove or attempt to remove or alter either the logo or watermark
on your digital proofs or proofs represented on your ProofPages.
Prints
The prints you purchase from Bella Carta become your physical
property, but the images contained therein remain property of Bella
Carta. You may do with your prints whatever you see fit in terms of
distribution and exhibition.
You may
NOT:
• Make a copy of any print by any mechanical or digital means
including but not limited to scanners, photocopiers, digital
cameras, etc. Your account information and photos will be archived
indefinitely so that you are always able to purchase more prints.
• Remove, attempt to remove, or otherwise inhibit the display of the
Bella Carta logo on anything we create and print.
Custom
Designs
Any custom designs created for you or your business remains property
of Bella Carta Designs and may be used in whole or in part for the
needs of future Bella Carta customers, unless you buy the full
rights to that design.
How to
Make Your Photos Yours
It is possible to own the rights to your photos or designs, allowing
you to do whatever you wish with them. Purchasing your photos will
get you a CD with our original, un-logoed photos from your shoot,
which you can manipulate and have printed in any manner or quantity
you’d like. They would essentially no longer belong to Bella Carta.
We may no longer advertise with or otherwise make money off of your
photos or designs after the full rights are transferred to you. We
may still use them as examples in portfolios or pamphlets, however.
The reason for this is because simply transferring ownership of
copyrighted material can never change the fact that it was Bella Carta’s photographers or designers who originally created the work.
Our
Privacy Policy
While Bella Carta could technically sell photos of you to someone
else e.g.—stock photography companies—it is our strict policy never
to do so without a signed Model Release form.
The
personal contact information you give us is never shared with or
sold to third parties. While you may receive promotional materials
from only Bella Carta via postal mail and email, you may request to
be removed from our mailing lists at any time. |
